Illegal Immigration and Homeland Security

Our national priority with regard to immigration policy and homeland security must be to get people who are illegally in America to declare their presence, report their earnings and pay their fair share of taxes. And they will do so only for good reason. My immigration policy provides a 90-day window when all illegal immigrants can register their presence in the United States with the federal government without fear of reprisal. When they register, every immigrant must provide his or her name, address, birth date, phone number, fingerprints and a cheek swab. In exchange, the immigrant will be converted from illegal status to registered applicant, provided a social security number and be availed of most of the privileges provided to resident aliens, except that the track to citizenship will be longer (so we do not reward violations of the law) and come with more conditions that must be met.

At the end of the 90-day period, if any person still remains in the U.S. who has not registered, then we can in good conscience presume that the person has failed to register because of a criminal history or other inexcusable reason. Therefore, our federal law would be fair in requiring all law enforcement agencies to turn over to Immigration and Customs Enforcement (ICE) any person who is present in the U.S. and has failed to register with the federal government after the 90-day period. Also at the end of the 90-day period, we must ensure that the our borders are sealed to stop the flow of illegal immigrants from any country.

After the 90-day period, no more illegal aliens will be permitted to become registered applicants and federal immigration law must be enforced as it is written. To this end, my policy expressly provides for state and local governments to enforce federal immigration law after the closure of the 90-day period.

All registered applicants will be put through a background check. If their fingerprints or DNA cross with any criminal cases, then the registered applicant will be reinstated to illegal status, and processed in accordance with federal immigration law: deported.

Adult registered applicants will also be required to file special tax returns every year, regardless of whether they earned the amount of income that would require an American citizen or resident alien to file a tax return. Continual filing of tax returns would help track where the registered applicants reside, and monitor whether they are making occupational or educational progress, and meeting certain minimum thresholds including basic knowledge of the English language.

The path to citizenship will take 13 years; longer than for any other immigrant group who entered and remained in America legally. So long as an immigrant remains in good standing as a registered applicant, and pays incremental registration fees along the way to citizenship, applicants would receive citizenship after 13 years. During the application period, all young applicants (under the age of 28) would be eligible for educational benefits comparable to those that are received by Americans so long as they maintained B- or above GPAs at accredited institutions, and did not develop criminal histories indicative of poor moral character.

This policy provides an earn-in method to citizenship, and for homeland and financial security.
