Should Section 501 of the County Charter be amended to required that personnel appointments serve the County's diverse population and to prohibit discrimination on the basis of disability or sexual orientation?
This measure would amend Section 501 to also require that personnel appointments serve the County's diverse population and to prohibit discrimination on the basis of disability or sexual orientation. A "yes" vote on this measure would amend Section 501 of the County Charter to require that personnel appointments made by the County serve the County's diverse population and to add to the Charter prohibition of employment discrimination on the basis of disability or sexual orientation. A "no" vote on this measure would leave Section 501 of the County Charter in its current form.

The current personnel policies in the County Charter do not include sexual orientation on the list of criteria on the basis of which discrimination is prohibited. The addition of sexual orientation to the list of impermissible criteria is consistent with state law and current county contract practice, both of which prohibit discrimination on the basis of sexual orientation. Further, the current county personnel policy prohibits discrimination on the basis of a person's "handicap." The current state of the law and employment practice is to avoid the use of the word "handicapped" and to refer to individuals who might be "disabled." This measure would reflect that change in terminology. Both of these changes will bring the Charter into compliance with state law.

Shall Section 501 of the County Charter be amended to read as follows:
Section 501. Personnel Policy. It shall be the policy of the County to recruit, select, retain, and promote the best qualified officers and employees to effect equal opportunity for all persons at all levels of County employment to serve the County's diverse population. Appointments and promotions shall be made on the basis of merit and in conformity with the principles of equal opportunity. Equality of employment rights shall not be abridged or denied to persons employed or seeking employment on the basis of race, color, sex, age, national origin, disability, sexual orientation, religious or political opinion or affliation, or union membership. |
