Do you support the City issuing $15 million in general obligation bonds, to be repaid from proceeds of a property tax surcharge, for the purpose of acquiring private property for city park, recreation and open space purposes?
Measure O is an Advisory Question, and its results are not binding. If approved, it will not authorize the issuance of general obligation bonds. If disapproved, it will not prohibit the issuance of general obligation bonds. Rather, it seeks to determine the level of voter support for such a bond to be issued in the future so that the City Council may consider that information. The stated purpose of Measure O is to determine whether there is a sufficient level of voter support for a bond issue with a property tax surcharge to justify moving forward with the proposal. Following the advisory election on Measure O, the City Council will decide whether to take those next steps, including engaging the financing professionals (underwriter, bond counsel, financial advisor) and preparing the formal bond issue documents. If the City Council decides that there is sufficient public support for a bond issue, it may decide to present that bond issue for official voter approval at a future election. At that future election, the voters of Malibu will be provided information concerning the amount of property tax surcharge which each property owner would pay to finance the bond issue. This advisory question, whether it is approved or disapproved by the voters, has no effect on the authority of the City under existing law to formally propose the issuance of bonds and to pursue all legally required procedures (including, where necessary, voter approval) for that issuance.
