Shall Ordinance No. 213 be adopted, requiring that any development agreement concerning real property more than 39 acres in size must be approved by both the City Council and the voters of the City of Malibu?
Under current law, a development agreement may be approved by the City Council and no voter approval is required. The City Council's approval takes the form of an ordinance. Like all ordinances, an ordinance which approves a development agreement is subject to referendum, provided a petition signed by 10% of Malibu's voters is submitted to the City within 30 days. Measure N would revise this procedure for any development agreement which meets two criteria: (i) the agreement relates to a commercial or mixed commercial/ residential project; and (ii) the agreement concerns more than 30 acres of land. If adopted, Measure N would require that such a development agreement be automatically submitted to the voters for approval. Measure N eliminates the 10% petition prerequisite imposed by the current referendum procedure. Voter approval under Measure N would constitute voter approval for any other City permit which may be required by law. Therefore, a project which requires multiple City approvals would not be presented to the voters at multiple elections, but rather would be presented to the voters at a single election. Measure N includes a provision addressing the possibility that it is approved and, at the same election, the voters approve another proposition dealing with residential, commercial or industrial development. In fact, there is a second proposition on the November 7, 2000 ballot dealing with commercial and commercial/ residential development entitled the "Malibu Right to Vote on Development Initiative." According to Measure N, if both ballot propositions are approved, and Measure N receives more votes, then it will prevail over the "Right to Vote" proposition, which will be void and have no effect.
