End the Lawsuits

NCWD has filed two lawsuits against the Castaic Lake Water Agency (CLWA) to: 1) stop CLWA's purchase of the Valencia Water Company (VWC) and 2) to challenge CWLA's new wholesale/imported water rate. Both suits are ill advised for the NCWD ratepayers in that their money is being spent to stop a purchase that does not involve any NCWD customers and only serves to increase the costs of both NCWD and CLWA water due to legal costs. Also challenging the VWC acquisition is the Santa Clarita Organization for Planning and the Environment (SCOPE). Whatever one may think of SCOPE, if your water provider is joining them in a lawsuit, it is a good indication that the customers' interests are being run roughshod over.

The new CLWA wholesale water rate is designed to be similar to the current method that NCWD currently charges it own customers. NCWD wants to only pay for the imported water used on a yearly basis. However, individual NCWD customers are charged for a connection fee and for imported water irrespective of the water they use or the quantity of imported water delivered. For instance, a NCWD Newhall service area customer pays, in addition to a flat connection fee, an imported water fee for every unit of water used. Typically the Newhall service area relies primarily on ground water and only about ten percent of the water used might be imported water. Whereas a customer in the Tesoro service area that gets 100% imported water all of the time pays exactly the same imported water surcharge as does the Newhall service area customer. All three of the remaining water retailers in the Santa Clarita Valley have decided to live with the wholesale water rate and NCWD customers, again, are the only ones that will suffer from the legal expenses from this ill-advised lawsuit.
