AMENDED RESOLUTION NO. 14-07-1 OF BOARD OF DIRECTORS OF DURHAM IRRIGATION DISTRICT
CALLING AN ELECTION FOR SUBMISSION OF A PROPOSAL FOR CHANGING THE REQUIREMENT THAT DIRECTORS BE RESIDENTS OF DIVISIONS TO BE RESIDENTS OF THE DISTRICT AT LARGE

WHEREAS, there are presently three directors of Durham Irrigation District, each of whom is a voter and a landowner in the District and a resident of the division he or she represents at the time of his or her nomination and through his or her entire term; and,

WHEREAS, the Board of Directors of the District believes that it would be in the best interests of the District that its directors no longer be required to be a resident of the divisions they represent but instead be required only to be residents of the District at large without regard to divisions, such that each director be a voter and landowner in the District and a resident of the District without regard to divisions;

NOW, THEREFORE, BE IT RESOLVED that pursuant to California Water Code Section 21554, the Board of Directors of Durham Irrigation District hereby calls an election of the District for the submission of a proposal for changing the requirement that directors be residents of the divisions they represent to the requirement that they only be residents of the District at large without regard to divisions and each director be a voter and landowner in the District and a resident of the District without regard to divisions at the time of his or her nomination and through his or her entire term.

BE IT FURTHER RESOLVED that if this proposal receives the approval of a majority of the voters of the District voting on it and also a majority of the voters voting on it in each of a majority of the divisions of District, then pursuant to California Water Code Section 21560, the terms of office of all directors shall expire at noon on the first Friday in December following the next general district election in 2016 and the directors elected at that election shall be three and they shall at their first meeting classify themselves and determine the length of their respective terms in the manner provided in California Elections Code Section 10505(c).

BE IT FURTHER RESOLVED that pursuant to California Elections Code Section 10403, this election shall be consolidated with the Statewide election on November 4, 2014.

BE IT FURTHER RESOLVED that the proposal to be voted on shall read as follows:

"Shall directors of Durham Irrigation District, who now are required to be residents of the divisions they represent, instead be required only to be residents of the District at large such that each director shall be a voter and landowner in and a resident of the District at large without regard to divisions?"

BE IT FURTHER RESOLVED that the consolidated election shall be held and conducted in the manner prescribed in California Elections Code Section 10418.

BE IT FUTHER RESOLVED that pursuant to California Elections Code Section 10002, request is hereby made to the Butte County Board of Supervisors to permit the Butte County Elections Official to render to the District all services necessary to submit the proposal to and conduct the election, including, without limitation, causing all necessary ballots to be printed, preparing and distributing all sample ballot pamphlets and absentee ballots, appointing all necessary election officials, making arrangements for precinct polls, and procuring and furnishing election officials with all necessary supplies and equipment.

BE IT FURTHER RESOLVED that pursuant to California Elections Code Section 10002, the District shall reimburse Butte County in full for the services performed upon presentation of its bill therefor to the District.

BE IT FURTHER RESOLVED the president and secretary of the District are authorized and directed to take all steps.necessary to implement the foregoing resolution.
