Shall Sections 2.01(D) and 8.01 and Section 7.05 of the Charter of the City of Piedmont be amended to conform the date of the City's General Municipal Election with the date of the statewide General Election in November; and conform the annual selection of officers of the Board of Education to the requirements of the California Education Code, respectively as more specifically set forth in Resolution 71-14 which is on file with the Piedmont City Clerk?

MEASURE GG

Measure GG would amend the Charter of the City of Piedmont ("Charter") related to the timing of the City's general municipal elections, including election of members of the City Council, and the requirements applicable to the election of officers by the Board of Education.

Currently, the Charter provides for the City to hold its general municipal elections,including its election of City Councilmembers, on the first Tuesday after the first Monday of February in even numbered years. Measure GG would amend the Charter to provide that general municipal elections would be held on the first Tuesday after the first Monday in November of each even numbered year and that the terms of Councilmembers would begin upon certification of the election results by the City Council. This Measure would also extend terms of those Councilmembers and members of the Board of Education whose terms currently expire in February 2016 and February 2018 until their successors in office have been sworn in following respectively, the November 2016 general municipal election and the November 2018 general municipal election.

Measure GG would also amend the Charter's provisions regarding the Board of Education's election of officers. Currently, the Charter provides that the Board of Education shall annually, between July 1 and July 15, elect a President and Vice-President of the Board. This Measure would amend the Charter to provide that the President and Vice-President shall be elected annually pursuant to the requirements of the California Education Code.

A "Yes" vote on Measure GG would 1) amend the Charter to provide that the City hold its general municipal elections, including its election of City Councilmembers, on the first Tuesday after the first Monday in November of each even numbered year; 2) amend the Charter to provide for the election of a President and Vice President of the Board of Education in accordance with the California Education Code; and 3) extend the terms of members of the City Council and Board of Education whose terms expire in February of 2016 and February 2018 until their successors in office have been sworn in following respectively, the November 2016 and November 2018 general municipal elections.

A "No" vote on Measure GG would retain the current dates for the holding of general municipal elections, including its election of City Councilmembers in February of even numbered years and retain July elections of the President and Vice-President of the Board of Education.

This Measure requires a majority vote (i.e. 50 percent plus one) to pass.

Arguments For Measure GG Arguments Against Measure GG
Moving Piedmont's Municipal Election from February to November will consolidate elections with the California State General Elections. This change will save taxpayer monies and facilitate increased voter turnout. The Piedmont Municipal Election in February, 2014 cost $81,757.00 or approximately $9.89 per registered voter. In contrast, the Piedmont Municipal Election in November, 2012 cost $8,936.00 or only about $1.10 per registered voter. The reason for the savings is that each entity (e.g. the City of Piedmont and the Piedmont School Board) that has a candidate and/or measure on the ballot pays its fair share of elections costs. By consolidating Piedmont's elections with the State General Election, the costs are shared among a much larger pool of jurisdictions resulting in significant cost savings. Moving the election date will help increase voter turnout. In the February, 2014 stand- alone Piedmont election, only 36.7% of those eligible voted. In the November, 2012 election, 83% of those eligible voted, and in the November, 2008 election, 86% of those eligible voted. Greater voter turnout makes for better government. Another provision of Measure GG is the removal of a requirement that the Piedmont Board of Education holds their elections for President and Vice President between July 1 and July 15 and will instead allow for those elections to take place in accordance with the California Election Code. Measure GG is supported by the entire Piedmont City Council and the entire Piedmont Board of Education. Vote yes to consolidate Piedmont's municipal elections with statewide elections.

CITY OF PIEDMONT

Resolution No. 71-14

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PIEDMONT TO ORDER SUBMISSION TO THE QUALIFIED ELECTORS OF THE CITY A MEASURE TO AMEND THE CHARTER OF THE CITY OF PIEDMONT SECTIONS 2.01(D), 8.01, AND 7.05 TO CHANGE THE DATE OF THE REGULAR ELECTION OF COUNCILMEMBERS, CHANGE THE DATE OF GENERAL MUNICIPAL ELECTIONS, AMEND ORGANIZATION REQUIREMENTS FOR THE BOARD OF EDUCATION, AND PROVIDE FOR THE ORDERLY TRANSITION OF COUNCIL AND BOARD MEMBERS

WHEREAS, pursuant to Sections 2.01(D) and 8.01 of the Charter of the City of Piedmont, General Municipal Elections have been held on the first Tuesday after the first Monday of February of even numbered years since the 2010 General Municipal Election; and

WHEREAS, no other city in Alameda County holds elections for City Council or Board of Education on this date and rarely do other agencies place measures on the ballot at this election, forcing the City of Piedmont and the Piedmont Unified School District to bear the full cost of this election; and

WHEREAS, the cost of conducting a standalone election in February has increased dramatically in recent years; and

WHEREAS, there has been extensive discussion around the community as to whether a February election date is the most efficient use of City resources; and

WHEREAS, the voter turnout for standalone elections is less than that of statewide elections; and

WHEREAS, the Piedmont City Council wishes to establish an election date which will reduce costs and increase voter turnout at municipal elections;

WHEREAS, pursuant to Section 7.05 of the Charter of the City of Piedmont, the Board of Education must re-organize annually between July 1 and July 15 to elect one of its own members to be president of the Board and another to serve as vice-president; and

WHEREAS, the Board of Education has requested that the Board be given more latitude to determine the date for its annual reorganizations; and

WHEREAS, it will be necessary to establish a process for the orderly transition of members of the City Council and Board of Education;

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Piedmont does hereby resolve, declare, determine and order as follows:

SECTION 1. Pursuant to Section 9.07 of the Charter of the City of Piedmont, the City Council proposes the following amendments to such City Charter:

a. Section 2.01(D) of the Charter of the City of Piedmont is amended to read as follows:

"(D) ELECTION. The regular election of Councilmembers shall be held at the General Municipal Election as provided for in Section 8.01 of this Charter. The terms of elected Councilmembers shall begin upon certification of the election results by the City Council. They shall hold office for four (4)years. Elections shall be alternately for two (2) and three (3) Councilmembers, excluding elections to fill an unexpired term of office."

b. Section 8.01 of the Charter of the City of Piedmont is amended to read as follows:

"SECTION 8.01 GENERAL MUNICIPAL ELECTIONS

General municipal elections for the election of officers, and for such other purposes as the City Council may prescribe, shall be held on the first Tuesday after the first Monday in November of each even numbered year."

c. Section 7.05 of the Charter of the City of Piedmont is amended to read as follows:

"SECTION 7.05 ORGANIZATION

The Board of Education shall annually, pursuant to the requirements of the California Education Code,elect one of its own members to be President of the Board and another to serve as Vice-President. Either of these officers may be removed by the affirmative vote of four (4) members."

SECTION 2. To provide for an orderly transition and notwithstanding any provisions of the Charter of the City of Piedmont to the contrary, including but not limited to Section 2.01(D) and Section 7.02 thereof, the terms of Councilmembers and members of the Board of Education whose terms of office expire in February 2016, shall have such terms extended until their successors in office have been sworn following the General Municipal Election of 2016. In addition, the terms of Councilmembers and members of the Board of Education whose terms of office expire in February 2018, shall have such terms extended until their successors in office have been sworn following the General Municipal Election of 2018.

SECTION 3. The foregoing amendments and changes to the Charter of the City of Piedmont shall be placed on the ballot at a Special Municipal Election to be held on November 4, 2014, and the City Council, by separate resolution, shall set procedural details for this election and request that the Alameda County Board of Supervisors consolidate such Piedmont Special Municipal Election with the general election to be held on such date.
