To provide funding that cannot be seized by the State, but will stay in Paso Robles for such things as street repair, maintenance, and improvement, and other vital city needs, shall the City of Paso Robles enact a temporary one half of one percent sales tax which will expire in 12 years?

Impartial Analysis from City Attorney
If approved by a majority of the voters voting on the measure, this measure would authorize a one-half of one percent sales tax within the City of Paso Robles. This sales tax would be a "general tax," meaning that revenues raised from the tax would go into the City's general fund to fund any lawful City program, improvement, or service. The City would not be required to use the revenues raised by the measure for any special purpose or for any particular program or service.

California Revenue and Taxation Code section 7285.9 authorizes the City of Paso Robles to levy a transactions and use tax (sales tax) at a rate of one-half of one percent so long as the tax is approved by two-thirds of the City Council and a majority of the voters voting in an election on that issue. If approved, the sales tax would become effective on April 1, 2013.

The tax would be paid in addition to current sales taxes and would be collected at the same time and in the same manner as existing sales taxes. All revenues raised by the tax would belong to the City and would not be shared with any other entity.

This sales tax would automatically sunset and be repealed 12 years after its effective date and could not be collected after that time unless a majority of the voters voting in an election approve an extension or re-authorization of the tax.

Arguments For Measure E-12
A program of regular road repair and maintenance costs over $3 million per year. A temporary supplemental one-half percent sales tax would provide that amount every year for 12 years. And, while other vital city services can be addressed, road repair is so expensive that supplemental income is needed to do it effectively.

Historically, gasoline taxes provided $400,000 per year for road maintenance. The State took these funds for the last several years during the recession to balance its own budget. When or if the State will take the funds again is unknown at this time. Additionally, since 2008, the City's income dropped $7,000,000 per year. Even so, the budget has been balanced by eliminating 35% of City jobs, freezing pay, and renegotiating pensions but there is not enough revenue to restore major City services or improvements.

The temporary one-half percent sales tax is a simple way to help restore major City services, with tourists and non-residents helping to pay for them. The money cannot be taken away by the State. Since it is a temporary tax, it would address immediate, one-time needs, rather than recurring obligations like additional staff or salaries. And, importantly, use of the money would be guided by voter preferences as recorded through an advisory measure (on this ballot) and by a citizen's tax oversight committee.
