Shall the ordinance permitting medical marijuana dispensaries of any size in any commercial, mixed use or industrial zones, setting regulations for their operation, and repealing the City's prohibition on medical marijuana dispensaries with more than three members be adopted?

Meaning of Voting Yes/No
A YES vote on this measure means:
A "yes" vote would permit dispensaries in the City and repeal the City's current ordinance which prohibits dispensaries involving more than three persons.

A NO vote on this measure means:
A "no" vote would leave in effect the City's prohibition on dispensaries with more than three persons.

Impartial Analysis from City Attorney
This ordinance, if approved by a majority of voters, would repeal the City's current prohibition on medical marijuana dispensaries involving more than three persons. It would permit dispensaries in any commercial, mixed use, or industrial zone in the City, as long as a dispensary is not within 300 feet of another dispensary or 600 feet from a school. The ordinance requires the City to issue an irrevocable license to any applicant for a proposed dispensary that is not within 300 feet of another dispensary. It requires dispensaries to charge sales tax according to state law.

The ordinance requires dispensaries to comply with various operating requirements, including the installation of security cameras, alarm systems, and interior/exterior lighting. The ordinance specifies that dispensaries may only provide medical marijuana to qualified patients and primary caregivers who are active, registered members of the subject dispensary. All dispensary employees and operators are required to be qualified patients, and dispensaries must maintain accurate patient records.

On-site smoking of marijuana would be permitted at dispensaries pursuant to the ordinance. A dispensary could sell properly-labeled food and beverage items containing marijuana, but no alcohol could be sold on-site. The ordinance allows outdoor growing of marijuana at dispensaries as long as the marijuana is not visible outside the property and is secured behind a locked gate or other security device. The ordinance requires any person under 18 who is at a dispensary to be a qualified patient and accompanied by a parent or guardian.
