Shall the permanent annual appropriations limit of the City of Jurupa Valley be set at $28,967,355?
At the time the City of Jurupa Valley was incorporated, the provisional appropriations limit, was set by the Riverside County Local Agency Formation Commission ("LAFCO") at $27,914,961 and enacted as part of the incorporation of the City of Jurupa Valley by the voters in 2011. Under the provisions of Government Code Section 56812, newly incorporated cities operate under the provisional appropriations limit set by LAFCO as a condition of incorporation until that limit is adjusted as permitted by law. Newly incorporated cities are then required to determine a permanent appropriation limit to be submitted to the voters at the first election after the first full fiscal year of incorporation. This November 2012 election is the first election after the City's first fiscal year. State law requires the permanent appropriations limit to be computed by adjusting the provisional limit for population increases or decreases and actual proceeds of taxes received. The proposed permanent limit in Measure "P" is $28,967,355 which is $1,052,394 greater than the provisional limit adopted by the voters in 2011 at incorporation. The appropriations limit does not mean the City will spend this much money, only that this is the maximum amount of the proceeds of taxes it may receive. The permanent limit will be adjusted annually using factors for changes in population and changes in income as provided in state law. A "yes" vote on Measure "P" would approve the appropriations limit for the City of Jurupa Valley at $28,967,355. A "no" vote means the appropriation limit is not adopted and the provisional appropriations limit set by LAFCO and adopted as part of the incorporation by the voters remains in effect unless and until a permanent appropriations limit is adopted by the voters. Measure "P" will be adopted if it is approved by a majority of the voters voting on the measure.

Arguments For Measure P |
The City Council of the City of Jurupa Valley urges your support of
Measure "P", which will enact a permanent limit on tax proceeds
appropriations for the City. Under California law, cities are required to
establish such limits based upon tax revenues received in the first full
fiscal year following incorporation as a City. This limitation is commonly
known as the "Gann Limit."
The Gann Limit established by Measure "P", correctly reflects the calculation required by California law and reduces the amount of money the City may appropriate for city expenditures. The provisional expenditure limit that was originally established before the City was formed was $27,914,961. The new limit that will be established by Measure "P" will be $28,967,355, as was adjusted pursuant to the requirements of the Gann Limit adopted in 1978. Once approved by the voters, that appropriations limit will be in effect and adjusted annually as prescribed by state law, unless it is adjusted by a vote of the people. Approval of this measure is necessary to bring the City of Jurupa Valley into compliance with the requirements of California Constitution Article XIIIB. If the measure is not approved, the provisional limit established prior to incorporation will remain in effect and will not represent the true limitation that should apply. It is important for Jurupa Valley to comply with state law. To accomplish that, your "yes" vote is essential. Please join with the leadership of the City in supporting Measure "P" so that Jurupa Valley will be in compliance with state law and certainty with regard to the fiscal operations of the City will be established.
