Shall the City Council provide sewer service to the following unincorporated county area described below? The unincorporated area known as the "Parklawn Neighborhood" which is described generally as the area bounded by Hatch Road on north, Pearson Avenue/Union Pacific Railroad on west, Nelson Way extended from the centerline of Nelson Way westerly to Union Pacific Railroad on south, and Morgan Road/Union Pacific Railroad on east.

Impartial Analysis from the City Attorney
The City Council of the City of Modesto has directed that an advisory measure concerning the extension of sewer service to the Parklawn Neighborhood area be submitted to City of Modesto voters. The Parklawn Neighborhood area is an unincorporated area of the County that is directly next to City of Modesto city limits.

California Elections Code Section 9603 authorizes cities to hold advisory elections for the purpose of allowing voters to voice their opinions on substantive issues and by so doing, provides an opportunity for voters to indicate their approval or disapproval of a proposal to the City Council. The Modesto City Charter also requires an advisory vote to be taken before the City Council takes any action to extend sewer service to specified areas.

This advisory measure asks the voters to voice their opinion with respect to whether the City Council should provide sewer service to the Parklawn Neighborhood area, which is more fully described in the measure itself. The outcome of the election will be canvassed and presented to the City Council as information concerning the opinions of the voters of the City regarding the provision of sewer service to the described area. However, the outcome of the election with respect to this measure will not bind the Council to act in any particular way with respect to either providing or not providing sewer service to the Parklawn Neighborhood area.

     You should vote "YES" on this measure if you want to advise the City Council that you are in favor of providing sewer service to the Parklawn Neighborhood area.

     You should vote "NO" on this measure if you want to advise the City Council that you are not in favor of providing sewer service to the Parklawn Neighborhood area.

These votes are advisory only. According to Section 9603(c), advisory votes express general voter opinion but do not bind the sponsoring legislative body to act.

Arguments For Measure L Arguments Against Measure L
The Modesto City Council has unanimously supported the placing of Measure "L" on the ballot. A YES vote would authorize the extension of sewer service to the Parklawn Neighborhood in southwest Modesto. This extension has become critically important due to the failure of many of the septic systems currently in use. The need for a sewer system has become an issue of health and safety that can no longer be ignored.

Please consider the following:

  • Winter rains cause overflow of sewage into yards and streets.
  • The neighborhood is geologically lower than the surrounding area causing even more septic system failures.
  • Two homes are sinking due to saturated soil.
  • Children and the elderly are particularly vulnerable to health problems caused by raw sewage collecting in walkways.

    This situation needs to be corrected now! Please vote YES on Measure "L". This decades long problem can and must be solved.
