Impartial Analysis from the District Counsel
"Shall an ordinance of the Santa Clara Valley Water District limiting Board members, whether elected or appointed after the established date, from serving more than three successive 4-year terms; which sets forth the effect of partial terms; and which establishes an effective date of December 3, 2010 be approved?"

In accordance with California Government Code section 53077, any proposal to limit the number of terms a member of a governing body of the district may serve on the government board of the district shall apply prospectively and shall not become operative unless it is submitted to the electors of the district at a regularly scheduled election and a majority of the votes cast on the question favor the adoption of the proposal.

This measure would approve adoption of an ordinance limiting the number of terms members of the District board may serve to three successive four year terms. A full four year term shall consist of either appointment to complete in excess of two years of a four year term or resignation by a member after having served more than two full years. A member may serve for any terms or terms after at least four years of absence in which the member has not served as Board member.

Arguments For Measure C Arguments Against Measure C

Newspapers and voters seemed to have no idea how much money the Santa Clara Valley Water District was wasting on high-paid managers until one elected Member of the Board of Directors quit several years ago to become a paid employee instead!

Term limits are preferable to foolishly electing and re-electing the same old career politicians who have gained seats on the Water Board and never seem to leave.

However, this measure would only impose a future limit on serving more than three successive 4-year terms. A politician could still sit on the Water Board for 12 years, take 2 years off, run again, and sit on the Water Board for another 12 years before taking a break.

A more effective practice might be for voters to VOTE AGAINST incumbents and other career politicians who run for seats on the Water Board UNLESS we are persuaded otherwise by the particular candidate.

More good persons would run for local office if we voters paid more attention and adopted this rule of thumb: WHEN IN DOUBT, VOTE THEM OUT!
