IMPARTIAL ANALYSIS
of a
MEASURE PROPOSING THE REPEAL OF
MENDOCINO COUNTY CODE CHAPTER 9.36
(MEASURE G) AND ADOPTING INSTEAD NEW
GUIDELINES NOT EXCEEDING THE STATE LIMIT
(MEASURE B)
This measure seeks voter approval for the adoption
of an ordinance which will replace the current
Mendocino County policy for medical marijuana
adopted by the Board of Supervisors in 2007 of
allowing possession of twenty-five (25) mature plants
and two (2) pounds of processed marijuana, with the
limits established by state law of six (6) mature or
twelve (12) immature plants and eight (8) ounces of
dried marijuana, unless a doctor's recommendation
states that a different amount is consistent with the
needs of a patient, in which case the patient may
possess an amount consistent with the doctor's
recommendation. The state limits are set forth in
Senate Bill 420 which became law in October 2003
and which established state guidelines for medical
marijuana. SB420 also provided that counties and
cities could retain or enact medical marijuana
guidelines allowing qualified patients or primary
caregivers to exceed the state limits.
The ordinance will also repeal Measure G which
was adopted as an initiative measure in 2000, and
which was later administratively incorporated into the
Mendocino County Code as Chapter 9.36 "Cannabis
Personal Use Ordinance for Mendocino County".
The stated purpose of Measure G was to establish a
maximum limit of plants and weight for cultivation and
possession of marijuana for personal, medical, and
recreational use in Mendocino County, and prohibit
the expenditure of public funds for enforcement of
marijuana laws against those who cultivate, possess,
and transport quantities below that limit, which was
identified by the Measure as twenty-five (25) adult
flowering female marijuana plants or the equivalent in
dried marijuana. Measure G also directed County
government to lobby for the decriminalization of
marijuana.
A YES vote will be a vote in favor of adoption of the
proposed ordinance.
A NO vote will be a vote against the adoption of the
proposed ordinance.
