Shall Charter Section 1007 be amended to add a provision that if two employee-nominated members of the Personnel Board are not nominated and elected within six months of a vacancy then the City Council may fill the vacancies by direct appointment and delete the prohibition against officers in any local, state or national partisan political organization from serving on the Personnel Board? ? YES NO
Sunnyvale Charter Section 1007 now provides that the Personnel Board consists of five members, with three members appointed directly by the City Council and two members appointed by the City Council from a list of five persons nominated by City employees. The Personnel Board has functioned with frequent vacancies in the City-employee nominated positions for several years because the City employees have not nominated persons for appointment to these positions. The proposed Charter Amendment will require the City employees to nominate one or more persons for a Personnel Board employee seat within six months of written notification of the vacancy, and allows the City Council to fill the employee-nominated seat directly if the nominations are not provided within six months. Upon the expiration of the term of a Personnel Board member appointed directly by the City Council for an employee-nominated seat, the seat will be filled from City employee nominations. Sunnyvale Charter Section 1007 now provides that an appointee to the Personnel Board cannot be an officer of any local, state or national partisan political club or organization. This means that a Sunnyvale resident who is an officer in a Democratic, Republican or other political affiliation organization is disqualified from serving on the Personnel Board. The proposed Charter Amendment will delete the provision prohibiting a Sunnyvale resident who is an officer in a Democratic, Republican or other political affiliation organization from serving on the Personnel Board. A "Yes" vote is a vote to amend Charter Section 1007 to delete the provision that an appointee to the Personnel Board cannot be an officer of any local, state or national partisan political club or organization, and to allow the City Council to directly appoint a person to the Personnel Board's employee-nominated seats if the City employees do not nominate one or more persons for the Personnel Board employee-nominated seats within six months of written notification. Over this past year, the Personnel Board was unable to take action because it lacked a quorum due to vacancies. Measure E provides another alternative for making appointments to the Personnel Board. The Personnel Board consists of five members. Three members are appointed directly by the City Council, and two members are appointed by the City Council from a list of five persons nominated by City employees. Vacancies have not been filled because City employees failed to nominate persons for appointment. Measure E corrects this problem. If the City employees fail to nominate one or more persons within six (6) months of written notification of the vacancy, Measure E allows the City Council to fill the employee-nominated seat(s) directly. Measure E also eliminates an archaic provision that restricts some Sunnyvale residents from serving based upon club or organizational leadership. Let's give the Personnel Board the quorum it needs to do its work. Join us in voting Yes on Measure E.

If Measure E carries, the City Charter of the City of Sunnyvale, shall be amended by amending Section 1007, of Article X (Appointive Boards and Commissions), to read as follows:
Section 1007. Personnel Board. There shall be a Personnel Board consisting of five members to be appointed by the City Council. To be eligible for appointment, each appointee shall neither hold public office or employment nor be a candidate for any other public office or position
The members of the Personnel Board shall be selected and appointed in the following manner: three of the members shall be appointed by the City Council directly. Two of the members shall be appointed by the City Council from a list of five persons to be nominated by election of the employees in the Classified Service. If the employees in the Classified Service do not nominate one or more persons to fill a vacancy for the employee-nominated seats within six (6) months of written notification, the City Council may appoint the person directly to fill the vacancy.
The successor of any member of the Board shall be appointed in the same manner as such member was appointed.
All persons appointed shall be registered voters of the City and shall maintain their principal place of residence within the City at the time of their appointment. If at any time during their term any member of the board shall cease to be an elector of the City or shall cease to maintain their principal place of residence within the City, then such person shall become ineligible to continue to serve as a member of the board and said position shall be declared vacant by the City Council. |
