Shall an ordinance be adopted amending Title 2, Chapter 2.08, Section 2.08.030(a) of the San Marcos Municipal Code to provide that each member of the City Council including the Mayor, shall receive a salary in the amount of $1,500 per month?
If approved, the proposed measure would amend Title 2, Chapter 2.08, Section 2.08.030(a) of the San Marcos Municipal Code to increase the City Council base compensation figure to $1,500.00 per month. Pursuant to California Government Code Sections 36516.0 through 36516.6, and Ordinance 90- 866 of the City of San Marcos, the statutory increase in Council compensation is limited to five percent (5%) per calendar year from the last voter-approved salary increase. Following the last five percent (5%) increase in July 2006, the City Council compensation is currently $931.09 per month. If approved by a majority of the qualified electors voting in the November 2006 election, the increase would become effective upon: (i) the expiration of 30 days after City Council adoption of an ordinance consistent with voter approval of the measure; or (ii) the beginning of the new term of office for the officials elected in the November 2006 election, whichever occurs later. The City Council retains the ability to increase City Council compensation up to five percent (5%) per calendar year without submitting the matter to a vote of the people.

The City Council of the City of San Marcos, California, in accordance with the passage of Proposition "K" by the affirmative vote of a majority of the qualified voters voting in the City of San Marcos Regular Municipal Election held on November 7, 2006, as certified by the Registrar of Voters, County of San Diego, on December ___, 2006, and in accordance with the freedom afforded to charter cities generally and by the Charter of the City of San Marcos specifically, as well as the provisions of California Civil Code Section 719 and California Government Code Section 37380, DOES ORDAIN as follows: SECTION 1. That Title 2, Chapter 2.08, Section 2.08.030(a) of the Municipal Code of the City of San Marcos is amended to establish the salary of City Council Members at $1,500 per month. For purposes of clarity, the existing language of Section 2.08.030(a) is set forth below, with the modifications shown as underlined text.
(a) Each member of the City Council, including the Mayor, shall receive a salary in the sum of SECTION 2. Except as specifically referenced in Section 2, above, the provisions of Title 2, Chapter 2.08, Section 2.08.030 shall remain in full force and effect, including, but not limited to, the provisions for annual five percent (5%) adjustments to City Council compensation. SECTION 3. If any section, sentence, clause or phrase of this Ordinance is determined to be invalid, illegal or unconstitutional by a decision or order of any court or agency of competent jurisdiction, then such decision or order will not affect the validity and enforceability of the remaining portions of this Ordinance. The City Council declares that it would have passed and adopted this Ordinance, and each section, sentence, clause or phrase thereof, regardless of the fact that any one or more sections, subsections, sentences, clauses, or phrases be declared invalid or unconstitutional. SECTION 4. In the event that there are competing measures on the same ballot with this measure that address the same subject matter as this measure and more than one measure passes, then the measure receiving the highest number of affirmative votes shall control and all other competing measures shall be null and void. SECTION 5. If approved by the voters, this proposition may be amended or repealed only by the voters at a Citywide election. SECTION 6. This Ordinance shall be effective thirty (30) days following its approval by a majority of those qualified electors voting in a Citywide election. Within fifteen (15) days following its adoption, the City Clerk shall publish this Ordinance, or the title thereof as a summary as required by state law. |
