A "yes" vote is a vote to amend Article X, Section 1016, of the City Charter of the City of Sunnyvale.

A NO vote on this measure means:
A "no" vote is a vote to not amend Article X, Section 1016, of the City Charter of the City of Sunnyvale.

Impartial Analysis from the City Attorney
California law permits amendment of the City Charter for the City of Sunnyvale if the amendment is approved by a majority of the voters in the city voting at an election.

Article X, Section 1016, of the City Charter of the City of Sunnyvale provides that the Heritage Preservation Commission has authority to advise the City Council regarding heritage resources, landmark sites, and landmark districts and that the City Council can by ordinance authorize the Commission to exercise functions with regard to landmark sites and landmark districts.

The Sunnyvale City Council proposes amending Article X, Section 1016, to provide that the Heritage Preservation Commission can include heritage resource sites in the scope of its ordinance authority for the Heritage Preservation Council, as it currently does for landmark sites and landmark districts. This amendment is consistent with City policy for protection of heritage resources.

A "yes" vote is a vote to amend Article X, Section 1016, of the City Charter of the City of Sunnyvale.

A "no" vote is a vote to not amend Article X, Section 1016, of the City Charter of the City of Sunnyvale.

If Charter Amendment H carries, Article X, Section 1016, of the Charter of the City of Sunnyvale shall be amended to read as follows:

Article X, Appointive Boards and Commissions. Section 1016. Heritage Preservation Commission. Powers and Duties.

The Heritage Preservation Commission shall have power to:

(a) Act in an advisory capacity to the City Council in all matters pertaining to heritage resources, landmark sites and landmark districts.

(b) Exercise such functions with respect to any heritage resource, landmark site or landmark district as may be prescribed by ordinance.
