The California Constitution and the California Government Code provide that community service districts may issue general obligation bonds for the acquisition or improvement of real property with the approval of two-thirds of the voters of the district, voting at an election for that purpose. Purposes for which community service districts may acquire or improve real property include the provision of public recreational facilities.

The Cameron Park Community Services District has proposed a measure to the voters that would authorize general obligation bonds of the community services district to be issued in an amount up to $8.5 million and would authorize ad valorem taxes to be levied upon taxable property in the District to repay the bonds. An ad valorem tax is a tax levied as a percent of the assessed value of the property. The measure provides that proceeds from the sale of the bonds will generally be used to construct and equip a recreational community center, including meeting rooms, classrooms, a youth activity center, facilities for senior needs and programs, recreational and competition pools, gym, exercise room and an assembly hall with a stage for community productions. The measure prohibits using any of the bond proceeds for District operating expenses.

If the measure is adopted, the Board of Directors of the District is required to appoint a Citizens' Oversight Committee to maintain financial accountability, prevent waste and ensure that no bond money is used for operating expenses. The Board of Directors of the Cameron Park Community Services District has called the election for the purpose of submitting the measure to the voters within the District. If two-thirds of the voters of the District voting on the measure vote yes, the District may proceed to sell the bonds and levy the related taxes as estimated in the Tax Rate Statement. If less than two-thirds of the voters of the District voting on the measure vote yes, the measure fails and the issuance of the bonds and the levy of the taxes for such bonded indebtedness will be disapproved.

A YES vote is a vote in favor of the measure.

A NO vote is a vote against the measure.

ARGUMENT IN FAVOR OF MEASURE C

Cameron Park residents deserve a community center. Our community has grown over the past few decades, and we need a central location for community gatherings, increased recreational programs and activities for our residents, youths to seniors.

Passage of Measure C will allow the Cameron Park Community Services District to construct a 28,655 sq. ft. community center that will include:

  • Aquatic center with recreational and competition pools
  • Locker, shower and restroom facilities
  • Gymnasium
  • Youth activity center
  • Theatre and stage for community productions
  • Assembly hall for banquets and receptions
  • Fully equipped kitchen
  • Dance and aerobics rooms
  • Meeting rooms
  • Administrative facilities

The entire community will benefit from Measure C. The proposed community center offers something for everyone. Through expanded programs, more children and adults will be able to participate in recreational activities locally. Local seniors will have access to new and expanded nutritional programs. Classrooms and meeting space will be available for educational programs and community meetings. Local theatre and dance groups can host productions locally. A local community center and expanded recreational programs will improve property values.

Measure C is a fiscally responsible way of providing much needed recreational facilities for our community. Measure C funds will only be used for the purposes specified in the ballot question. It is not an obligation by the District or County.

Measure C is a unique opportunity for our community to improve recreational facilities and programs by generating funding critical for the construction of a community center. It is the right thing to do and the most cost-effective way to do it. Join parents, community members and your neighbors in support of Measure C. Please vote Yes on Measure C.

TAX RATE STATEMENT REGARDING PROPOSED $8,500,000 CAMERON PARK COMMUNITY SERVICES DISTRICT GENERAL OBLIGATION BONDS

MEASURE C
An election will be held in the Cameron Park Community Services District (the "District") on March 8, 2005, for the purpose of submitting to the electors of the District the question of incurring a bonded indebtedness of the District in a principal amount of $8,500,000. If such bonds are authorized and sold, the principal thereof and interest thereon will be payable from the proceeds of tax levies made upon the taxable property in the District. The following information regarding tax rates is given to comply with Section 9401 of the California Elections Code. Such information is based upon the best estimates and projections presently available from official sources, upon experience within the District, and other demonstrable factors.

Based upon the foregoing and projections of the District's assessed valuation, and assuming the entire debt service will be paid through property taxation:
1. The best estimate of the tax which would be required to be levied to fund the bond issue during the first fiscal year after the sale of the first series of bonds based on estimated assessed valuations available at the time of filing of this statement is $28.71 per $100,000 of assessed valuation for the year 2005-06.
2. 2. The best estimate of the highest tax rate which would be required to be levied to fund the bond issue and an estimate of the year in which that rate will apply based on estimated assessed valuation available at the time of filing this statement is $28.82 per $100,000 of assessed valuation for the year 2015-16.

Attention to all voters is directed to the fact that the foregoing information is based upon projections and estimates only. The actual times of sales of said bonds and the amount sold at any given time will be governed by the needs of the District and other factors. The actual interest rates at which the bonds will be sold, which in any event will not exceed the maximum permitted by law, will depend upon the bond market at the time of sales. The actual assessed valuations in the future years will depend upon the value of property within the District as determined in the assessment and the equalization process. Hence, the actual tax rates and the years in which such rates are applicable may vary from those presently estimated as above stated.

of the Cameron Park Community Services District
October 20, 2004

RESOLUTION OF THE BOARD OF DIRECTORS OF THE CAMERON PARK COMMUNITY SERVICES DISTRICT ORDERING AN ELECTION, AND ESTABLISHING SPECIFICATIONS OF THE ELECTION ORDER

WHEREAS, pursuant to Government Code Section 61650, the Board of Directors (the "Board") of the Cameron Park Community Services District (the "District") has determined pursuant to Resolution No. 2004-25, adopted on August 25, 2004, that the public interest and necessity required the issuance of bonded indebtedness for the construction of a new recreational community center to serve the current and future needs of the residents of the District; and
WHEREAS, following proper notice as required by Government Code Sections 61651 and 61652, the Board, on September 15, 2004, conducted a public hearing to accept comments from the public on whether the construction of a new recreational community center would benefit the entire District or only a portion of the District; and
WHEREAS, following such public hearing, the Board adopted Resolution No. 2004-26 that determined that the whole of the District would benefit by the accomplishment of the issuance of bonds for the construction of a new recreational community center in the District; and
WHEREAS, the Board has previously found that the Cameron Park area lacked essential recreational facilities for local youth, adult and senior populations; and
WHEREAS, the Board determined that such a community center, which includes a swimming pool, gymnasium, assembly hall, and administrative facilities, within the District is needed to enhance the recreational opportunities of all of the residents of the District; and
WHEREAS, among the purposes of the community center would be to provide a gym for youth and adult sports programs; meeting rooms for community use; a room dedicated to dance and aerobic exercise classes; a fully-equipped kitchen to support a senior meal program and nutritional program; a theatre with stage for community-sponsored theater, art and dance productions; an assembly hall for receptions and banquets; a youth activity center; and a swimming pool for recreation, competitions, classes and an exercise area for handicapped residents; and
WHEREAS, in the judgment of the Board, it is advisable to provide the funding for the District's facility needs by means of a local general obligation bond where all the bond money will stay in the community and be used only for a community center which would serve the needs of the entire community; and
WHEREAS, Proposition 46, approved by the voters of the State of California on June 3, 1986 ("Proposition 46"), amended Section 1(b) of Article XIIIA of the California Constitution by adding a provision which exempts from the 1% of full cash value limitation those ad valorem taxes used to pay for debt service of any bonded indebtedness for the acquisition or improvement of real property approved on or after July 1, 1978, by two-thirds of the votes cast by voters voting on the proposition; and
WHEREAS, in the judgment of the Board, it is advisable to order the El Dorado County Registrar of Voters to call an election pursuant to Government Code Section 61659 on the question of whether general obligation bonds shall be issued and sold on behalf of the District for purposes set forth herein; and
WHEREAS, Section 9400 et seq. of the Elections Code of the State of California (the "Elections Code") requires that a tax rate statement be contained in all official materials, including any ballot pamphlet prepared, sponsored or distributed by the District, relating to the election; and
WHEREAS, the Board desires to authorize the filing of a ballot argument in favor of the proposition to be submitted to the voters at the election; and
WHEREAS, pursuant to the California Elections Code, it is appropriate for the Board to request consolidation of the election with any and all other elections to be held on Tuesday, March 8, 2005, and to request the El Dorado County Registrar of Voters to perform certain election services for the District;
NOW, THEREFORE, THE BOARD OF DIRECTORS OF THE CAMERON PARK COMMUNITY SERVICES DISTRICT DOES HEREBY RESOLVE, DETERMINE, AND ORDER AS FOLLOWS:

Section 1. That the Board, pursuant to Government Code Section 61659, hereby orders the El Dorado County Registrar of Voters to call an election and submit to the electors of the District the question of whether bonds of the District in the aggregate principal amount not to exceed $8,500,000 (the "Bonds") shall be issued and sold to raise money for the purposes of constructing a new recreational community center which would include swimming pools, gymnasium, assembly hall and administrative facilities, and as further described in Exhibit "A" hereto.
Section 2. That the date of the election shall be March 8, 2005.
Section 3. That the purpose of the election shall be for the voters in the District to vote on a proposition, a copy of which is attached hereto and marked Exhibit "A" and incorporated by reference herein, containing the question of whether the District shall issue the Bonds to pay for improvements to the extent permitted by such proposition.
In calling for the election, the Board hereby determines
(i) that it is necessary to incur the bonded indebtedness, since without it the District would be unable to provide such facilities to the public, and
(ii) that as previously determined, the whole of the District would be benefited by incurring the bonded indebtedness and constructing the community center.
Section 4. That the authority for the specifications of this election order is contained in Government Code Section 61659.
Section 5. That this Resolution shall stand as the order to the El Dorado County Registrar of Voters to call an election within the boundaries of the District on March 8, 2005. Pursuant to Government Code Section 61660, this Resolution shall constitute the notice of the special bond election and the General Manager of the District shall arrange for this Resolution to be published once a week for two successive weeks, or as otherwise required by Government Code Section 6066.
Section 6. That the Secretary of the Board is hereby directed to send a certified copy of this Resolution to the El Dorado County Registrar of Voters no later than November 3, 2004.
Section 7. That the El Dorado County Registrar of Voters and the El Dorado County Board of Supervisors are hereby requested to consolidate the election ordered hereby with any and all other elections to be held on March 8, 2005 within the District.
Section 8. That the maturity of any bonds issued pursuant to Government Code Sections 61670 et seq. hereto shall have a maturity not exceeding forty (40) years. The maximum annual rate of interest on any bond shall not exceed the maximum rate allowed by Government Code Section 61659, as modified by Government Code Section 53531, and that interest may be payable annual or semi-annually, or in part annually and in part semi-annually.
Section 9. That the Board requests the governing body of any such other political subdivision, or any officer otherwise authorized by law, to partially or completely consolidate such election and to further provide that the canvass be made by any body or official authorized by law to canvass the returns of the election; and that the Board consents to such consolidation.
Section 10. Pursuant to Section 10002 of the Elections Code, the Board of Supervisors of El Dorado County is requested to permit the Registrar of Voters to render all services specified by Section 10418 of the Elections Code relating to the election, for which services the District agrees to reimburse El Dorado County, such services to include the publication of a Formal Notice of Bond Election and the mailing of the sample ballot and tax rate statement (described in Section 9401 of the Elections Code) pursuant to the terms of Section 12112 of the Elections Code.
Section 11. The District is hereby authorized to submit to the El Dorado County Registrar of Voters a Tax Rate Statement for inclusion in the sample ballot and voter pamphlet which shall include the best estimate of the tax rate for the issuance of bonds:
(i) during the first fiscal year after the first sale of the bonds;
(ii) during the first fiscal year after the last sale of the bonds, if the bonds are proposed to be sold in series; and
(iii) the highest tax rate in the fiscal year.
Section 12. The District is hereby authorized to file a written argument in favor of the measure set forth in the recitals hereof in accordance with Article 4, Chapter 3, Division 9 of the Elections Code of the State of California.
Section 13. The District hereby directs the El Dorado County Registrar of Voters to transmit a copy of the foregoing measure to the El Dorado County Counsel, and directs the County Counsel to prepare and submit to the Registrar of Voters an impartial analysis of the foregoing District measure, all pursuant to California Elections Code Section 9280.
Section 14. The District adopts Subdivision (a) of Section 9285 of the California Elections Code and hereby authorizes those persons filing the direct argument in favor of the foregoing District measure to, if deemed advisable in their sole discretion, prepare and submit a rebuttal argument not exceeding 250 words and to file such rebuttal argument with the elections official not more than 10 days after the final date for filing direct arguments in accordance with Article 4, Chapter 3, Division 9 of the Elections Code of the State of California.
Section 15. That pursuant to Government Code Section 61659(a) the El Dorado County Registrar of Voters will
(i)maintain the polls from 7 a.m. to 8 p.m. on March 8, 2005;
(ii) establish the boundaries of the voting precincts within the District;
(iii) fix the location of polling places dependent on what other elections will be conducted within the District; and
(iv) select the officers to conduct such elections within each precinct.
