Shall Section 811 of the Charter of the City of Santa Cruz be amended to provide that the City Clerk shall have the power and be required to preserve the record of all proceedings of the City Council in files that shall bear appropriate titles and be devoted to such purpose.

Fiscal Impact from Director of Finance:
This ballot measure, if approved, would reduce costs of the paper used in printing ordinances and resolutions and the "books" used to bind these records. Current costs vary from year to year for these items, but cost approximately $500 to $600 per year. If approved, this ballot measure would eliminate most of this cost, provide for a more efficient electronic storage of records, and provide improved security of existing records.

CITY CLERK POWERS AND DUTIES + MAINTENANCE OF OFFICIAL RECORDS

Currently Section 811 of the City of Santa Cruz City Charter requires the City Clerk to maintain a full and true record of all of the proceedings of the City Council in "books" that shall bear appropriate titles and be devoted to that purpose.

In addition, the City Clerk is required to maintain ordinance and resolution "books" into which shall be recorded all City ordinances and resolutions accompanied by a certificate of the Clerk stating that the ordinance or resolution is an original or a correct copy of the original.

This ballot measure, if adopted by the voters, would amend the Charter to allow the City Clerk to maintain these records in "files" instead of "books." This Charter amendment would therefore allow the City Clerk to comply with the Charter's record maintenance requirements through the use of computerized files and would dispense with the antiquated requirement that these records be maintained only in books.

This Charter Amendment provides for more efficient and safer archiving of the minutes, resolutions and ordinances of the City of Santa Cruz. This Amendment authorizes filing of records in acid free paper, and

o provides better protection than with the current method of bound books;

o reduces costs since leather bound books will no longer be necessary; and

o authorizes use of computer imaging systems to scan originals for faster and more efficient retrieval of documents.

Full Text of Measure O
Section 811, City Clerk Powers and Duties.

The City Clerk shall be the Clerk of the Council, and shall have the power and be required to:

a) Attend all meetings of the City Council and record and maintain a full and true record of all of the proceedings of the City Council in files that shall bear appropriate titles and be devoted to such purpose. The City Clerk shall maintain a general index sufficiently comprehensive to enable a person readily to ascertain matters contained therein;

b) Maintain ordinance and resolution files, into which shall be recorded all City ordinances and resolutions with the certificate of the Clerk annexed to each thereof stating the same to be the original or a correct copy, giving the number of said ordinance or resolution and, as to an ordinance requiring publication, stating that the same has been published or posted in accordance with this Charter;

c) Be the custodian of the seal of the City;

d) Administer oaths or affirmations, take affidavits and depositions pertaining to the affairs and business of the City and certify copies of official records;

e) Attend to the publication of all ordinances and all public notices when so directed by the Council or City Manager;

f) Have charge of all City elections;

g) Perform such other duties as required by law, ordinance, or direction of the City Manager.
