Proposition 103 required that auto insurance premiums must be based upon a driver's history and driving record. Additionally, the Insurance Commissioner is charged with determining which additional factors may be included and the weight that each factor should be given in determining rates. This step, which is critical to ensuring proper implementation of Prop 103 and fair rates for drivers, has yet to be completed. As Insurance Commissioner, I intend to develop guidelines to properly weight such additional factors to ensure that rates are determined under the guidelines established by law. Some consumer advocates believe that zip codes are unlawfully being used as a primary factor in determining insurance rates. If true, this type of "red-lining" is unacceptable and in violation of Prop. 103. As Commissioner, I would stop that practice. During this legislative session, I introduced AB 5 which prevents insurers from using a driver's credit history to determine auto insurance rates. The need for this legislation demonstrates the important role the Commissioner must play in establishing guidelines and ensuring proper implementation of Prop 103 so that consumers are protected. |
