For the transfer of territory from Santa Clara Unified School District to East Side Union and Orchard School Districts.
A majority of the members of the governing boards of the Santa Clara Unified School District, the East Side Union High School District and the Orchard School District approved resolutions to adopt the change. After receiving the resolutions, the Santa Clara County Committee on School District Organization recommended to the Superintendent of Schools that the thirty-five parcels within the Santa Clara Unified School District transfer territory to the East Side Union High School District and to the Orchard School District. The Superintendent of Schools has provided notice of the transfer in accordance with state law. A "yes" vote is a vote to approve the transfer of thirty five parcels within the jurisdiction of Santa Clara Unified School District to the East Side Union High School District and to the Orchard School District. A "no" vote is a vote not to approve the transfer of thirty five parcels within the jurisdiction of Santa Clara Unified School District to the East Side Union High School District and to the Orchard School District. The Moitozo Property which is located in the City of San Jose is currently being developed as a high-density apartment complex. This property is located between the boundaries of Trimble Road to the South, the East side of First Street to the West side of Zanker Road and Baypoint Drive to the North.
The Santa Clara Unified School District became a Basic Aid district in 07/2000 and therefore must rely on funding from property taxes rather than funding from the state based on the number of students attending its schools. With the development of the Moitozo Property, the Santa Clara Unified School District will see an influx of 250-400 additional students attending its schools. Because the district relies on property taxes for its funding source, it will not receive any funds to educate these students from the State of California and all property taxes will go to the City of San Jose because the property is in a redevelopment area. The Santa Clara Unified School District has determined that it is not in the best financial interest of the district to retain the Moitozo property within the jurisdictional boundaries of its district. The potential cost to Santa Clara Unified, after this property is fully built upon, would be over $1 million per year. An agreement to a territory transfer of the Moitozo Property from the jurisdiction of Santa Clara Unified School District to that of Orchard School District and East Side Union High School District has been separately approved by each of the involved districts. These two other districts, since they are funded directly by the State, will receive around $5,000 per child to educate the children from this area. The Santa Clara County Committee on School District Organization has also approved the transfer of the Moitozo property.
