Shall the City Council provide sewer service to the area of the Modesto Urban Area General Plan which is described in the Sample Ballot as set forth in Measure N, provided the area is first annexed to the City?

Meaning of Voting Yes/No
A YES vote of this measure means:
you want to advise the City Council that you are in favor of providing sewer service to the "Roselle/Claribel Comprehensive Planning District (southwest quadrant consisting of 480 gross acres)".

A NO vote of this measure means:
you want to advise the City Council that you are not in favor of providing sewer service to the "Roselle/Claribel Comprehensive Planning District (southwest quadrant consisting of 480 gross acres)".

Impartial Analysis from the City Attorney
The City has placed Measure N on the ballot for this regular municipal election to seek the advice of the electorate with respect to whether the City Council should provide sewer service, after annexation, to that area of the Modesto Urban Area General Plan known as the "Roselle/Claribel Comprehensive Planning District (southwest quadrant consisting of 480 gross acres)" which is more fully described in the measure. The outcome of the election on this measure will be canvassed and presented to the City Council. This election result will provide information to the City Council concerning the inclination of the voters of the City regarding the provision of sewer service to the "Roselle/Claribel Comprehensive Planning District (southwest quadrant consisting of 480 gross acres)". However, the outcome of the election with respect to this measure, shall not bind the Council to act in a particular way with respect to either the provision or the non-provision of sewer service to that area.

You should vote "YES" on this measure if you want to advise the City Council that you are in favor of providing sewer service to the "Roselle/Claribel Comprehensive Planning District (southwest quadrant consisting of 480 gross acres)".

You should vote "NO" on this measure if you want to advise the City Council that you are not in favor of providing sewer service to the "Roselle/Claribel Comprehensive Planning District (southwest quadrant consisting of 480 gross acres)".

Arguments For Measure N Arguments Against Measure N
The City Council evaluated a number of requests this year to place sewer service extensions on the ballot.

The Roselle Neighborhood was the only neighborhood respected community organization such as the League of Women Voters and G.O.A.L. (Growth Orderly Affordable Livable) supported placing before the voters.

After much public debate the City Council overwhelmingly supported placing only one neighborhood on the ballot--the Roselle Neighborhood.

We urge you to vote YES on Measure N for the following reasons:

  • The Roselle Neighborhood steers future growth away from the most fertile soils because it exists on lesser quality soils.

  • The Roselle Neighborhood residents and businesses will receive sewer services which are far better for the environment and the City's water supply than the continued use of septic tanks.

  • The Roselle Neighborhood provides for the construction of a one mile portion of the Pelandale Expressway, thereby providing a key element towards the completion of a much needed crosstown circulation artery.

  • The Roselle Neighborhood is being designed by one of the state's leading land planning firms and will include internal pedestrian trails, storm drainage with dual-use facilities such as lakes and parks, an elementary school, and a variety of housing types.

  • The Roselle Neighborhood provides infrastructure financing which will require future development to pay for and install key components of the infrastructure BEFORE the neighborhood is built out.

Please join us in voting YES on Measure N. Together we can send a message that we want sewer services extended only to neighborhoods that are carefully and responsibly planned.

This is a vote on whether to extend sewer service to 480 acres of land that Is not now in the city limits, for use as residential development.

The city limits now contain enough land for another 28,000 people to be added to the population, which would take care of growth for years. This 480 acres would bring another 7,200 people.

Rebuttal to Arguments Against
In its support of placing Measure N on the ballot, G.O.A.L. (Growth Orderly Affordable Livable) said, "Advance the Roselle/Claribel CPD for a Measure N vote in November for the following reasons:

  • "To maintain an inventory of land available to prevent short term deficiencies in the housing market five years out."

  • "Continues the logic of moving development toward the lesser quality soils."

  • "It is contiguous to the existing development in Village One."

The League of Women Voters had this to say about a public vote on the Roselle Neighborhood: "We believe that the only Measure N vote should be on Roselle - Claribel CPD."

The City Council overwhelmingly supported putting the Roselle Neighborhood on the ballot.

Mr. Burke's argument against Measure N is inaccurate. The argument overstates the future residential uses in the Roselle Neighborhood by at least a third, by neglecting to take into consideration the already existing residential and commercial development within the Roselle Neighborhood, as well as the proposed commercial land uses arid public facilities such as schools and parks. The argument also fails to mention the Roselle Neighborhood will actually solve traffic problems by:

  • Reducing the need for cross-town traffic;

  • Providing needed roadway improvements In the area; and

  • Redistributing traffic off of overburdened City streets.

A "Yes" vote on Measure N sends the message that we want sewer service extended to areas that are responsibly planned.

"Roselle/Claribel Comprehensive Planning District (southwest guadrant consisting of 480 gross acres)"

The unincorporated area designated "Roselle/Claribel Comprehensive Planning District" in the Modesto Urban Area General Plan. Generally located, the unincorporated area is, east of Oakdale Road, north of Sylvan Avenue, west of Roselle Avenue and south of the future extension of the Pelandale Expressway.
