Shall Section 1403 be added to the City Charter to require that the election of the Mayor shall require a majority of the votes cast at said election to constitute the choice of the electors, and if no candidate receives a majority of the votes cast, a runoff election between the two candidates receiving the highest numbers of the votes cast, or in case of a tie, among those candidates tying for the highest number of votes cast, shall be called by the City Council?

City Attorney's Impartial Analysis of Measure (C)

This measure amends the Gilroy City Charter by adding a new City Charter Section 1403, which will govern how the election of the Mayor is to be held. Currently, the election of the Mayor requires a plurality of the votes cast in the general municipal election to constitute a choice of the electors. This Charter amendment provides that the Mayor shall be elected by a majority of the votes cast for that office in the general municipal election. This section further provides that if no candidate receives a majority of the votes cast, a runoff election between the two candidates receiving the highest number of votes cast, or in the case of a tie vote, among those candidates tying for the highest number of votes cast, shall be called by the City Council and held on a Tuesday not less than 40 nor more than 125 days after the date upon which the City Council accepts the certified election results. This Charter amendment further provides that the City Council shall adopt any implementation measures and set any required deadlines that may be necessary to conduct the runoff election. The candidate receiving the highest number of votes cast in the runoff election shall be elected Mayor. /s/ Linda A. Callon, City Attorney The above statement is an impartial analysis of Measure (C). Arguments For Measure C Arguments Against Measure C

Measure C is a solution in search of a problem. It is a last minute scheme that would waste your tax dollars on a special election for the Mayor's Office. Under our current system, the mayoral candidate with the most votes is declared the winner. This is the same for each Council seat. The Mayor has no special privileges and has only one vote like any other person serving on the City Council. Unfortunately, Measure C is a maneuver by proponents who only have their own political self-interest in mind. It is an attempt to get a second chance at the Mayor's Office at public expense. It has nothing to do with what's best for Gilroy. No one has conducted an independent, impartial analysis to determine the Measure's impact on the community. Furthermore, there has been no public input on this Measure. The estimated cost alone for a special election could cost as high as $60,000. A special election would lengthen the election cycle by 40 to 125 days, forcing candidates to continue raising money. It also increases the chance of negative campaigning. Meanwhile, we would have a City without a Mayor. Our community has more important issues that we need to tackle. We should focus our taxpayer money on public safety, transportation improvements, sidewalks and neighborhood parks. We can do much more with $60,000 than spend it on a special election. Gilroy deserves better. Measure C is a waste of tax dollars and unfair to Gilroy voters.
