Shall the Town of Discovery Bay adopt the additional purposes of providing for the collection or disposal of garbage or refuse matter; protection against fire; provision of street lighting; provision of mosquito abatement; the equipment and maintenance of a police department, other police protection, or other security services to protect and safeguard life and property; to acquire sites for, construct, and maintain library buildings, and to cooperate with other governmental agencies for library service; the constructing, opening, widening, extending, straightening, surfacing, and maintaining, in whole or in part, of any street in the district, together with the construction and improvement of bridges, culverts, curbs, gutters, drains, and works incidental thereto, subject to the consent of the governing body of the county or city in which the improvement is to be made; to contract for ambulance service to serve the residents of the district as convenience requires; to provide transportation services; to abate graffiti; to construct, maintain, and operate flood protection works and facilities, subject to the following conditions: (1) The planning, design, construction, maintenance, and operation of flood protection works and facilities, or substantially similar works or facilities, is not within the authority of another public agency, except that a public agency and the district are not precluded from entering into agreements for the district to provide those services (2) The governing body of the city or county in which the services specified in paragraph (1) are to be provided by the district has consented to the district providing those services.

Impartial Analysis from City Counsel
The Town of Discovery Bay is a community services district. A community services district may exercise those powers granted to it by law and designated in its formation petition. To exercise additional lawful purposes, a community services district may submit to the voters of the district the question of whether he district should adopt the additional lawful purposes. If approved by the voters of the district, and approved by the Local Area Formation Commission, the district may exercise the additional lawful purposes.

The Town of Discovery Bay currently exercises the powers of providing water and sewer services, and recreation services. The ballot measure would authorize the Town to exercise the following additional lawful purposes:

  • 1. Collection and disposal of garbage and refuse matter.
  • 2. Protection against fire.
  • 3. Provision of street lighting.
  • 4. Provision of mosquito abatement.
  • 5. Equip and maintain a police department, other police protection, or other security services to protect and safeguard life and property.
  • 6. Acquire sites for, construct, and maintain library buildings, and cooperate with other governmental agencies for library service.
  • 7. Construct, open, widen, extend, straighten, surface, and maintain, in whole or in part, any street in the Town, and construct and maintain bridges, culverts, curbs, gutters, drains, and works incidental to the provision of services regarding streets (subject to the consent of the governing body of the county or city in which the improvement is made).
  • 8. Contract for ambulance services to serve the residents of the Town as convenience requires.
  • 9. The provision of transportation services.
  • 10. The provision of graffiti abatement.
  • 11. Construct, maintain, and operate flood protection works and facilities (subject to the statutory conditions set forth in the ballot measure).

A majority of those voting on the ballot measure must approve the measure in order for it to pass.

Arguments For Measure V Arguments Against Measure V
The Town of Discovery Bay Community Services District (Town) may exercise many different community services' powers; however, each power must first be approved by the voters of the Town, and then also approved by the Local Agency Formation Commission (LAFCO).

The Town is presently authorized to exercise powers only for water, sewer, and recreation. Since its formation three years ago, it has become apparent that the Town's citizens desire the Town Board of Directors to take on a broader role in local affairs. The exercise of each power will require a significant planning effort and submission of a plan of services and financing to LAFCO.

However, before going to LAFCO, the voters must approve the exercise of a power. To do this, power by power, as the Town grows and takes on more responsibility, would require a constant series of elections, which costs the citizens money for every request.

This Measure, if approved, would establish the voters' approval for all remaining necessary powers, and avoid future repetitive elections and cost. It would enable the Town to then plan to actually exercise powers on a long-term basis. In the future as voters decide the Town of Discovery Bay to activate individual powers, a separate ballot measure and voter approval would be required.

Please vote Yes on this Measure to enable the Town of Discovery Bay to better serve its citizens.
