Shall an ordinance be approved to extend until 6/30/2009 the existing 5.5% Utility Users Tax, collected only in the unincorporated areas (e.g. Ashland, Castro Valley, Cherryland, Fairview, San Lorenzo, Sunol), which funds County services, including services to unincorporated areas (e.g. Sheriff, Library, Planning and Code enforcement), and to amend the tax to include additional telecommunications services? The tax DOES NOT APPLY in Alameda, Albany, Berkeley, Dublin, Emeryville, Fremont, Hayward, Livermore, Newark, Oakland, Piedmont, Pleasanton, San Leandro, or Union City.

Financial Implications: The annual cost for an average 1,900 square foot home would be $4.94, and for a 10,000 square foot industrial property or 5000 square foot commercial property would be $52.00.

Shall the Business License Tax Ordinance be amended to correct an error made in 1991 by providing that the Business License Tax rate applicable for providers of health, veterinary, legal, educational, engineering-architectural-surveying, accounting-auditing-bookkeeping, and miscellaneous services not otherwise classified be increased to the pre- 1900 rate of $3.60 for every $1,000 in gross receipts?

Shall the rent ordinance be amended to restrict a landlord's ability to evict for landlord/relative occupancy by: prohibiting evictions where a landlord owns a comparable vacant unit; providing $4500 in relocation assistance to certain low-income tenants; prohibiting evictions of some elderly and disabled tenants; restricting the units which may be subject to landlord/relative move-ins; providing for the evicted tenant's right of re-occupancy; and providing for a prevailing tenant's right to attorneys' fees in an eviction? Financial Implications: None

To repair, upgrade and add new classrooms to address overcrowding and facilitate reduced class sizes at Berkeley High School, King Middle School and other Berkeley schools, shall Berkeley Unified School District issue $116,500,000 in bonds, at interest rates within legal limits, to finance acquisition or improvement of property for school safety and improved environment including building new classrooms; increasing seismic safety; replacing deteriorating floors, windows, restrooms, and roofs; upgrading school kitchens; modernizing science labs; and improving fire safety?

Measure BB. Special Tax Levy -- Berkeley Unified School District

To provide safety and essential maintenance of school buildings and grounds, shall the Berkeley Unified School District be authorized to levy a special tax of 4.5c/square foot on residential buildings and
6.75c/square foot on commercial buildings, for a period of 12 years? Revenues will be used for maintaining school buildings and classrooms, roofs, boilers, restrooms, lighting, electrical systems, playgrounds and addressing fire and health safety hazards.
