Because the City of Malibu is a "general law" city, state law governs the qualifications for holding office on the City Council. Under state law, a person who contemplates running for city council must be an elector of the city, and must be registered to vote in the city at the time nomination papers are issued to the candidate. Proposition 140, which was enacted as a statewide initiative in 1990, imposes term limits upon holders of state offices, but does not affect local elections. State law authorizes adoption of a term limit ordinance if approved by a majority of votes cast at a regularly scheduled election, such as the general municipal election to be held in Malibu on April 11, 2000.

If this ballot measure is approved by the voters, it will prevent future members of the Malibu City Council from serving more than two terms of office. A term of office under the ordinance that would be enacted by this measure is either a full four year term, or any part of a four year term.

Thus, a person who serves two terms will not be eligible to run for a third term. A council member who is elected or appointed to serve less than four years of a term will only be eligible to serve one other term.
