Shall the Charter of the City of Culver City be amended to change the reference in Sections 1312 and 1315 from "Controller" to "Finance Director" and to add a new section establishing the Finance Director's responsibilities for budget, finance and accounting functions and to reassign the accounting duties from the City Treasurer to the Finance Director?
Impartial Analysis from City Attorney
Under existing Culver City City Charter Sections 1312 and 1315, the Chief Administrative Officer (CAO), personally, or through the Controller, if one exists, is responsible for preparation of the City Budget. Proposed Measure P would change the title of the "Controller" to "Finance Director," as referenced in Sections 1312 and 1315. It also would amend the City Charter by adding Section 1317 to establish specified powers and duties for the Finance Director position, including the responsibility to assist the CAO in budget, finance and accounting matters. In addition, the Measure provides the Finance Director will audit and approve all claims, demands or charges against the City, before payment. A provision is also included which will allow the City Council to have the authority to approve a demand for payment, which has been denied by the Finance Director.

Proposed Measure P also would transfer the responsibilities for the accounting duties in the City from the City Treasurer to the Finance Director. Thus, City Charter Section 602, subsections (d) through (f), which set out the accounting duties under the City Treasurer's powers and duties, will be transferred to the new Section 1317 as required powers and duties of the Finance Director.
