Shall Section 601(a) of the Charter of the City of Culver City be amended to require that the City Clerk or Deputy City Clerk shall attend all City Council meetings, unless excused by the City Council; and to require that if the City Clerk fails to attend City Council meetings for a sixty (60) consecutive day period without Council approval, the City Clerk shall forfeit his/her office?

Impartial Analysis from City Attorney

Under Section 601(a) of the current Culver City City Charter, the City Clerk is required to attend City Council meetings. Under current practice, the City Clerk has delegated that responsibility to others within the City Clerk's Department. Proposed Measure O would amend the City Charter to require that either the City Clerk or the Deputy City Clerk attend City Council meetings, unless excused by the City Council. Proposed Measure O would add a provision that if the City Clerk is absent from City Council meetings for more than sixty consecutive days, without the City Council's consent, he or she will be required to forfeit the Office. This requirement is similar to existing Charter Section 504, which requires forfeiture of office if a member of the City Council is absent, without consent, for a similar period of time.

Under the existing Charter, the City Clerk is authorized to record and maintain a full and true record of all City Council proceedings. Measure O will amend the Charter to also permit the Deputy City Clerk to record and maintain a true and full record of City Council proceedings.
